TERMS OF THE INSTAGRAM CONTEST WITHOUT OBLIGATION TO BUY
ORGANIZED BY BONPOINT
FROM 15/11/2023 TO 19/11/2023
Article 1 – SUBJECT
The company BONPOINT, registered in the PARIS Trade and Companies Register under the number 702 041 526, located at 62 avenue d'Iéna, 75116 (hereinafter the "Organizer"), is organizing from 15/11/2023, starting at 12:00 pm, to 19/11/2023 at 11:59 pm (UTC+1) a contest with no obligation to buy (hereinafter the "Contest"), accessible on our Instagram account and its rules on our website.
Participation in the Contest implies full acceptance of these rules.
The Contest will be accessible on Instagram, via the Bonpoint (@bonpoint).
The Contest is not sponsored or operated by Instagram. Therefore, any comments, questions or complaints regarding the Contest should be directed to the Organizer and not to Instagram. The information provided by participants is provided to the Organizer and not to Instagram.
Article 2 – PARTICIPATION
The Contest is open to all natural persons of legal age (hereinafter the "Participant"), except for staff members of the Contest organizers, and any person who has participated directly or indirectly in its organization or execution, as well as their spouses and family members in the direct ascending and descending lines.
Participation in the Contest is limited to one entry per household (same name, same address). Participation is strictly nominative and the Participant may under no circumstances play under several pseudonyms or on behalf of other persons.
The Organizer reserves the right to ask any Participant to prove these conditions. Any Participant who does not meet these conditions or who refuses to provide proof will be excluded from the Contest and will not be entitled to his or her prize if he or she wins. Similarly, any false declaration, indication of identity or address will result in the immediate elimination of the Participant and, if applicable, the reimbursement of the prize(s) that may have already been sent.
To participate, simply follow the Instagram accounts of Bonpoint (@bonpoint); add a "like" to the contest-related post on the Instagram page of Bonpoint; mention two users in the comments of the contest-related post.
The information and contact details provided by the Participant must be valid and sincere, under penalty of exclusion from the Contest and, if applicable, loss of the status of winner.
It is strictly forbidden, by any means whatsoever, to modify or attempt to modify the devices of the Contest, in order to change the results or influence by an automated and / or unfair means the designation of a winner.
Each Participant shall refrain from using, directly or indirectly, any method of interrogation or systematized query of the Instagram social network.
In the event that a Participant has apparently won a prize in contravention of these rules, by fraudulent means, such as an automated search, through the use of an algorithm or by an unfair means (for example: registration in self-help or vote exchange groups or any similar process), or by any means other than those resulting from the process described in these rules, his or her prize would not be awarded and would remain the property of the Organizer, without prejudice to any possible proceedings that may be brought against the Participant.
Article 3 – DESIGNATION OF WINNERS - AWARDING OF PRIZES
3.1. Designation of winners
The winner will be designated on 20/11/2023 through a private message.
The Organizer will send a private message to the winner, via the Bonpoint Instagram account (@bonpoint) used when Participants entered the Contest, on 20/11/2022. Thereafter, the winner will be confirmed by email within 7 days on the terms and conditions to receive his/her prize.
In this regard, the Organizer cannot be held responsible for sending emails to an inaccurate address due to an error on the part of the Participant, nor for the malfunction of the email sending device.
3.2. Awarding of prizes
Within 30 days of the sending of the e-mail confirming the win, the winner must, by return e-mail, accept his or her prize in order to claim the prize.
The winner's silence within the above-mentioned period will be considered as a pure and simple renunciation of the prize. In this case, the winner drawn next on the list will be designated in his place.
The Organizer cannot be held responsible for sending the gift to an inaccurate address due to an error made by the winner in entering his or her email address.
3.3. Kind of prize
The winner wins the following package worth 550€.

- This season, the Bonpoint calendar is back with a new concept of a "house" to build as the days go by.
- This exclusive, modular suitcase can be used both as a toy and a decorative object.
- As part of an eco-responsible approach, the suitcase features elements that are destined to last over time.
The winner will accept the prize as offered, without the possibility of exchanging it for cash or other goods or services of any kind.
The Organizer reserves the right to replace any prize with another prize equivalent in value or characteristics, for any reason whatsoever (in particular in the event of stock shortage) without its liability being incurred in this regard.
Article 4 – PERSONAL DATA
Personal data will not be collected or processed for the purpose of this contest.
Article 5 – LIMITATION OF LIABILITY
Participation in the Contest implies unreserved acceptance of these rules in their entirety, of the rules of ethics in force for the Internet, and of the laws and regulations in force.
Participation in the Contest implies knowledge and acceptance of the characteristics and limits of the Internet, particularly with regard to technical performance, response times for consulting, querying or transferring information, the risks of interruption, and more generally, the risks inherent in any connection and transmission on the Internet, the lack of protection of certain data against possible misappropriation and the risks of contamination by possible viruses circulating on the Internet network.
Consequently, the Organizer cannot, under any circumstances, be held responsible, without this list being restrictive:
- the content of the services consulted on the Site and, in general, any information and/or data disseminated on the services consulted on the Site;
- the transmission and/or reception of any data and/or information on the Internet;
- any malfunction of the Internet network preventing the proper conduct or operation of the Contest
- failure of any receiving equipment or communication lines;
- loss of any paper or electronic mail and, more generally, loss of any data;
- routing problems;
- the functioning of any software;
- the consequences of any virus, computer bug, anomaly, technical failure;
- any damage caused to a Participant's computer
- any technical, hardware or software failure of any kind that prevents or limits the possibility of participating in the Contest or that damages a Participant's system.
It is specified that the Organizer cannot be held responsible for any direct or indirect damage resulting from an interruption, malfunction of any kind, suspension or termination of the Contest, for any reason whatsoever, or for any direct or indirect damage resulting in any way from a connection to the Site. It is the responsibility of each Participant to take all appropriate measures to protect his or her own data and/or software stored on his or her computer equipment against any attack. The connection of any person to the Site and their participation in the Contest is done under their entire responsibility.
Article 6 – ACCESS AND INTERPRETATION OF THE RULES – MODIFICATIONS
The present rules of the Contest are available on the Site via the link www.eu.bonpoint.com and can be obtained by simple request by email to the following address: communication@bonpoint.com. In the event of modification, the modified rules will also be accessible under the same conditions.
No oral or postal requests concerning the Contest will be answered. Any claim must be sent in writing to the Organizer at the above-mentioned address before 30/11/2023. After this deadline, no claim will be accepted.
Any question of application or interpretation of the rules, or any unforeseen question that may arise, will be decided by the Organizer.
The Organizer reserves the right to extend, shorten, modify or cancel the Contest at any time, particularly in the event of force majeure, without the Participants being able to claim any compensation.
Article 7 – APPLICABLE LAW AND JURISDICTION
THE PRESENT RULES ARE SUBJECT TO FRENCH LAW.
ANY DISPUTE RELATING TO THE APPLICATION OR INTERPRETATION OF THESE RULES SHALL, IN THE ABSENCE OF AN AMICABLE SETTLEMENT BETWEEN THE PARTIES, BE SUBJECT TO THE JURISDICTION OF THE FRENCH COURTS.
