Terms of sales Bonpoint Stores
ARTICLE 1. OUR COMMERCIAL POLICY
Bonpoint sells products in its stores by exclusively engaging in its own retail activity with respect to consumers, end customers, hereinafter referred to as "Client".
Bonpoint refers to the company Bonpoint Rive Droite SAS, a simplified joint-stock company whose registered office is located at 62, avenue d’Iéna 75116 Paris, registered with the Paris Trade and Companies Register under the number 348 890 476.
The Client is defined as any natural person who does not operate for professional purposes or related to a business activity. In light of the commercial policy described above, Bonpoint reserves the right not to process orders from parties other than the Client as defined above or from orders that do not comply with its commercial policy.
These General Terms and Conditions of Sale (hereinafter "GTC") exclusively govern any direct sale made in Bonpoint-branded Stores to the exclusion of any other document specific to the e-commerce site or other marketing channels.
"Any sales contract between the Client and Bonpoint made in a Bonpoint store is governed by these General Terms and Conditions, which the Client acknowledges and accepts without the sales contract being conditioned by a handwritten signature from the Client."
ARTICLE 2. IN-STORE PURCHASE AT BONPOINT
The products offered for sale are those that are available in the store or in stock on the day of the Client's visit, within the limits of available stock.
The Products are presented to consumers and the staff in the Store provides any additional information and a complete description of their essential characteristics.
The Client is also offered the possibility to place an order by phone with their usual store or to reserve their product online and pick it up in-store within the availability times indicated to them. In these cases, the general terms and conditions of sale of the e-commerce site apply. bonpoint.com "available online at any time and specific to distance selling, remain applicable between the Parties."
ARTICLE 3. INFORMATION RELATING TO PRODUCTS
In its sales network, Bonpoint exclusively offers products from luxury and top-quality brands. These products are purchased directly by Bonpoint from fashion houses, producers, and carefully selected retailers for their rigorous quality controls.
Bonpoint does not sell second-hand, defective, or substandard products compared to those offered on the market.
The price of the Products is fixed. The applicable rate is the one indicated on the products themselves. These prices take into account the VAT applicable on the day of the order. Any packaging and delivery fees may be charged in addition, and in this case, they will be specified to the Customer during the purchasing process. Their amount is then fixed and flat.
Bonpoint reserves the right, which the Client accepts, to modify its prices at any time, without any other formality than to indicate the changes on the product labels. However, these modifications will not affect purchases already made, subject to the availability of the ordered Products.
All products are equipped with an identification label. In case of return, as stated in Article 5 below, it is imperative that the label and the single-use seal of the Products have not been removed.
In the event of a request to exchange, Bonpoint may refuse to take back any product that is missing its label, altered in its essential or qualitative characteristics, or that has been damaged.
ARTICLE 4. PAYMENTS
For the payment of the price of the products and any associated services, the Boutique staff assists the Client with all the necessary information. Only cash payments and payments made with a Bonpoint voucher, a gift card, or a credit card are accepted. Payments by check are not accepted.
In the case of payment by credit/debit card, financial information (for example, the credit/debit card number or expiration date) will be transmitted using an encrypted protocol, providing services related to remote electronic payment, without any third parties being able to access it in any way. Such information will never be used by Bonpoint, except to complete the procedures related to your purchase or to issue refunds in the event of a possible return of products following the right of withdrawal or if it is necessary to prevent or report to the police the occurrence of fraud. Under no circumstances will Bonpoint retain your banking details. Transmissions to banks are encrypted and secure.
When the order is placed by phone, the Customer may be asked to log in via a secure link in order to proceed with the payment. The data is transmitted directly to Bonpoint's banking service provider, who is in no way the recipient of the Customer's payment data. Payment can be made in whole or in part with a Gift Card. The Bonpoint gift card is valid for 1 year from the date of purchase, on the online sales site. fr.bonpoint.com and in Bonpoint stores in the country of issue, excluding department stores and outlets. Usable in one or more transactions up to its amount. Can be supplemented by another payment method. Cannot give rise to any change. Cannot be used for the purchase of gift cards. Cannot be exchanged or refunded, even partially, particularly in case of loss, theft, or damage or expiration.
The Client is invited to keep their receipt or invoice from the store.
ARTICLE 5. EXCHANGES AND RETURNS
- Purchase Boutique: exchange possible for a duration of 30 days (from the delivery of the products in the Bonpoint store of the country of origin, in the case of a distance sale (excluding department stores)). A credit note will be issued if the exchange is not possible. Exception: during the SALE period, no credit note or exchange is possible.
- Purchase on the website : size exchange possible for the same item (in a store in the country of origin of the order excluding Italy) no credit note possible. If the customer wishes for a refund, they must refer to the return procedure indicated on the Return Slip in the package.

Personalized products (embroidery, engraving, gilding...) will not be returned or exchanged.
ARTICLE 6. PRODUCT WARRANTY
The Client benefits from the conformity guarantee under articles L217-4 and following of the Consumer Code as well as the legal warranty against hidden defects on the products, under the conditions of articles 1641 to 1649 of the Civil Code.
This means that all Bonpoint products are covered by the legal warranty against hidden defects and that in the case of a defect not initially apparent on a product or a defect that appears under normal use conditions, Bonpoint commits to take back and exchange or repair the product and offer an exchange or a credit note as applicable. Exception: items purchased in Bonpoint Outlet stores or from resellers are neither taken back nor exchanged nor refunded and cannot be subject to after-sales service by Bonpoint or a credit note.
ARTICLE 7. PERSONAL INFORMATION
The Client may be required to register in Bonpoint's customer file and provide the personal information collected about them. This information is strictly confidential. In accordance with law n°78-17 of January 6, 1978, relating to data processing, files, and freedoms, the processing of personal information collected on the Site has been declared to the National Commission for Information Technology and Civil Liberties. The Client has the right to access, modify, rectify, and delete data concerning them. To exercise this right, the Client must send an email to europe@support.information-bonpoint.com.
If registered in the Bonpoint customer file, the Client may receive emails from the Site regarding information about Bonpoint's Products and activities. The Client retains the right to refuse such communication, either by not giving consent at the time of creating their customer account, or at any time on the account management pages, or by clicking on the unsubscribe link in an informational email, or by sending an email to europe@support.information-bonpoint.com.
ARTICLE 8. INTELLECTUAL PROPERTY
The intellectual property rights attached to the Products sold by Bonpoint are and remain its exclusive property. All exploitation rights are exclusively reserved to it. Under these conditions, no one is authorized to reproduce, exploit, distribute, or use in any capacity, even partially, the intellectual property rights, without the prior written consent of Bonpoint. The brands and logos of Bonpoint are registered trademarks. Any reproduction therefore constitutes an infringement.
ARTICLE 9. MISCELLANEOUS PROVISIONS
The ownership of the Products is only transferred to the Client after full payment of the price by the latter. However, the risks concerning the delivered Products (notably loss, theft, or deterioration) are assumed by the Client as soon as the products are handed over by the sales staff.
Bonpoint shall not be held responsible for the total or partial non-performance of its obligations if it is due to the occurrence of a force majeure event, which is unpredictable, irresistible, and external to Bonpoint, as recognized by the case law of French courts, making the execution of the sales contract impossible. In this case, Bonpoint will inform the Client and propose one or more alternative solutions. The occurrence of such an event constitutes a cause for the suspension and/or extinction of Bonpoint's obligations towards the Client, without compensation in favor of the Client.
Bonpoint archives orders and payment receipts on a reliable and durable medium that constitutes a faithful copy, in accordance with the applicable legislation.
The computerized records of Bonpoint are considered by the Parties as proof of the communications, orders, payments, and transactions that have occurred between them. The Client agrees that all correspondence, communications, or transmissions of information between them by electronic means shall be presumed to have the same evidential value as a written document on paper.
If any of the provisions of these General Terms and Conditions were to be deemed null under an applicable legal rule or a final judicial decision, it would then be considered unwritten, without leading to the nullity of the contract, nor affecting the validity of its other provisions.
ARTICLE 10. APPLICABLE LAW – CLAIM
The sale of Bonpoint products in stores and these General Terms and Conditions are governed by French law.
In case of questions or complaints, the Client may first contact the Bonpoint Customer Service by email or phone at the contact details provided in the FAQ or by mail to the headquarters of the company BONPOINT, 62 avenue d’Iéna 75116 PARIS France.
Failing that, the competent courts are those within the jurisdiction of the Client's place of residence.
